Non-binding nature of contents and offers of the Z-Pass web services.

The contents and offers of the Z-Pass web service are non-binding and non-committal. We reserve the right to change, supplement, delete or temporarily or definitively discontinue the publication of parts of the website or the entire web service without any specific announcement.

Exclusion of liability

We are committed to ensuring that the contents and offers on our web service are up-to-date, correct and complete. However, we do not assume any liability for the up-to-dateness, correctness, completeness or quality of the Z-Pass web service. Provided that no demonstrably intentional fault of the Z-Pass exists, liability claims against the Z-Pass that pertain to direct or indirect damages and consequential damages of a material or immaterial nature shall be excluded. Exclusion of liability includes damages and losses which were caused by

  • the use or non-use of the information, programmes, data and references,
  • the use of faulty and/or incomplete information, programmes, data and references,
  • not using the Z-Pass web services, or
  • transmission errors, etc. (e.g. due to interruption of Internet operations, malfunctions, viruses, harmful components, misuse by third parties as well as loss of programmes or other data in your information systems).

Using the Z-Pass web services as well as their contents and offers shall be at the user's own risk.

We do not check web services and their contents and offers that are accessible via or linked to the Z-Pass web services. Consequently, we accept no responsibility for them. Access to these websites, utilisation of the information, programmes, data and references presented by them and the use of offers contained therein shall be at the user's own risk.

Copyright

The entire content (texts, graphic elements, pictures, logos, etc.) on the Z-Pass website is copyright-protected and is the property of the Z-Pass. Protection and usage rights of the Z-Pass and third parties concerning the contents of the Z-Pass website must be observed. Information, programmes, data and references as well as offers presented on the website are made available by the Z-Pass for private use and information purposes only.

Without our prior written approval it is prohibited to reproduce, link, copy or change any contents on the Z-Pass website for public or commercial purposes. This also applies when the source and the copyright of the Z-Pass is indicated. By downloading or copying Z-Pass web pages no rights are transferred to you.

Please send your request concerning the use of copyright-protected contents to ZVV Contact (by e-mail to contact@zvv.ch, by post to ZVV Contact, Postfach, 8040 Zurich or call us at 0800 988 988). Please make sure that you do not send any confidential details by e-mail. If necessary, your request is forwarded to the legal service of the Z-Pass and processed as quickly as possible.

Data protection

Data protection while using the Z-Pass web services is based on our Data protection statement.

Locating function

The "current location" function in the electronic timetable uses GPS, W-LAN or the browser's own locating function, depending on the terminal device. Especially the browser's own locating function may lead to imprecise results or no results at all, if you have switched off the locating function in the browser or if the exact location of your device cannot be identified due to specific functional aspects of the network. The latter mainly occurs in corporate networks and with Swisscom subscribers who access the Internet via a LAN-connection.

Place of jurisdiction and applicable law

Zurich courts have jurisdiction for any disputes between the Z-Pass and yourself as a user of the Z-Pass website that may arise from the use of the Z-Pass website, the use of the information, programmes, data and references presented as well as the use of offers. Subject to the use of any compulsory courts of jurisdiction. Swiss law applies.

Principles of data processing within the public transport sector

Public transport companies treat their customers’ data in confidence.

Protecting your personality and privacy is a major concern for us as public transport companies. We guarantee to you that we will process your personal data in accordance with the applicable provisions of data protection law.

By adhering to the following principles, public transport companies give a clear signal that your data will be handled in confidence:

You decide yourself how your personal data are to be processed.

Where permitted by law, you can at any time object to data processing, withdraw your consent or require that your data be erased. You always have the option of travelling anonymously without your personal data being recorded.

We offer you added value by processing your data.

Public transport companies use your personal data exclusively in relation to the provision of services and in order to offer you added value throughout the mobility chain (e.g. bespoke offers and information, support or compensation in the event of disruption). Your data are therefore used only in relation to the development, provision, optimisation and assessment of our services or for customer support purposes.

Your data are not sold.

Your data are only disclosed to selected third parties specified in this Privacy Policy and only for the purposes specifically indicated. If we commission third parties to carry out data processing, they will be required to comply with our data protection standards.

We guarantee the security of your data and ensure that they are protected.

Public transport companies undertake to handle customer data with care and to guarantee their security and protection. We ensure this by adopting the necessary technical and organisational precautions.

Data processing within Z-Pass

Basic principles

Z-Pass is a partnership comprising the partners Zurich Transport Network ZVV and the adjacent A-Welle, OSTWIND, Schwyz and Zug fare transport networks as well as SBB (further information is available at https://www.z-pass.ch/zpass/en/about-us/z-pass.html).

As a general rule, the individual Z-Pass partners are responsible for the processing of Z-Pass customer data (i.e. personal data concerning the individual Z-Pass ticket or railcard holder). For further information, please refer to the privacy policies of the individual Z-Pass partners:

 

The operator of the distribution system on which you purchase a Z-Pass service also processes your data for the purpose of completing the purchase. The relevant operator is exclusively responsible for such processing (and as the case may be any further processing in addition to completing the purchase), and its privacy policy alone is applicable.

Specific arrangements relating to the notification service

The only exception from the above principle relates to the notification service, which informs you by letter, email or SMS concerning the expiry or renewal of your Z-Pass railcard. This is a service provided by the Z-Pass partnership as a whole. For this purpose, the Z-Pass partnership has commissioned the firm MNC with preparing and sending the relevant letters, emails and SMS messages. MNC also processes personal data (customer data) in relation to this mandate. However, it only does so where necessary in order to provide the said service for the Z-Pass partnership and is under a contractual obligation to comply with the Privacy Policy as applicable from time to time.
